1. ASSUMPTION OF RISK

I fully understand and acknowledge that outdoor recreational activities involve inherent risks, both known and unknown, including but not limited to:

• Use of recreational equipment (e.g., hiking gear, tools, watercraft, flotation devices, camping gear)
• Participation in activities such as: hiking, swimming (pool or lake), fishing, canoeing, kayaking, paddleboarding, nature walks, camping, wildlife encounters, outdoor fires, and related outdoor travel
• Unpredictable weather, terrain, natural hazards, and wildlife
• Risks of slips, falls, allergic reactions, water-related accidents, equipment failure, and human error
• Misjudgment by staff or other participants regarding terrain, route, elevation, or participant readiness

I acknowledge that these activities may result in bodily injury, property damage, illness, disease, permanent disability, or death, and such risks may arise from the negligence of Spring Lake Ranch MO, its agents, myself, other participants, or other causes.

2. RELEASE AND WAIVER OF LIABILITY

I, for myself, my heirs, personal representatives, executors, administrators, and assigns, voluntarily release, waive, discharge, and agree to hold harmless and indemnify Spring Lake Ranch MO from any and all claims, demands, causes of action, or liability for:

• Bodily injury
• Property damage
• Wrongful death
• Loss of services
• Medical costs
• Any other losses arising from or related to participation in activities, whether caused in whole or in part by the negligence or conduct of Spring Lake Ranch MO or otherwise.

I specifically understand that I am waiving and releasing any and all claims for negligent acts or omissions by Spring Lake Ranch MO, including claims arising in the future.

3. EQUINE ACTIVITY NOTICE

In accordance with Missouri Law (RSMo 537.325), if I or a minor participate in horseback riding or any equine-related activity, I understand the following:

• A separate equine activity waiver is required, which I must sign before participating.
• I acknowledge the inherent risks of equine activities, including but not limited to the unpredictable behavior of horses.

4. VENUE, GOVERNING LAW, AND SEVERABILITY

Any dispute arising from this agreement shall be governed by the laws of the State of Missouri. Venue shall lie exclusively in the Washington County Courthouse in Potosi, Missouri, or the Missouri Supreme Court in Jefferson City. If any portion of this agreement is held unenforceable, the remainder shall continue in full force and effect.

5. MINOR PARTICIPATION

As the parent or legal guardian of a participant under 18 years of age:

• I consent to their participation.
• I sign this agreement on their behalf.
• I authorize emergency medical treatment and understand that I am solely responsible for all related costs.

6. GENERAL PARTICIPANT RESPONSIBILITIES

I agree to follow all posted rules and staff instructions. I will not use alcohol or substances that impair judgment before or during participation. I agree to use appropriate safety equipment (life jackets, helmets, footwear) and confirm that I and any minor for whom I sign are physically and mentally capable of participation.

I further acknowledge and agree to the following:

• No ATVs, off-road vehicles, or motorcycles are permitted on the property.
• Motorized vehicles shall not be used to explore the property's trails or off-road areas. All vehicles must remain on the designated main road at all times.

ACKNOWLEDGMENT

I have carefully read this Agreement and understand its contents. I am aware this is a release of liability and a contract. I sign it voluntarily and agree that no oral representations, statements, or inducements apart from this written agreement have been made.

I am entering this release on behalf of myself and any minor listed below, and for all of their and my heirs, executors, and assigns.
